Problem with State Field

I notice that when you have state set up to always show with the pulldown box that if you have Javascript turned off it will show both the state pulldown box and also a field to type in the state (and both are listed as required even though if you don't type anything into the state box it still goes to the next page). What code changes can be made to fix this?

There is no "fix" - most folks use JS these days and does it matter as long as you can proceed?
