That is for the NEWSLETTER, not for the email all customers function. Two different things.
Admin->Tools->Send Email->Send Email To Customers
When I open the Customer drop down I get

More choices .....
(And then a list of all customer names)

If you have customers who NEVER want ANY emails from your store (including no order-related emails) you can use phpMyAdmin to edit their customer record in the customers table in your database, and set the customers_email_format field to NONE instead of TEXT or HTML.
But, if you do that your store will NEVER email them anymore, even if they purchase something. They would have to re-select either TEXT or HTML from their My Account screen to re-choose their email preference if they wanted to once again start receiving those emails.
It's better to use the Newsletter option so customers can opt-in or opt-out as desired.

What you are trying to do fits this definition to a T.UCE (unsolicited commercial e-mail) is a legal term used to describe an electronic promotional message sent to a consumer without the consumer's prior request or consent.
Many hosts will drop you and some countries allow you to be sued.
Why not start by contacting those who purchased recently and give them some incentive to subscribe.
BTW, defaulting to subscribe on the register page is illegal in some countries as well.
