I want to use the element for the visual purpose but not sure I have any links I really want in the bar as most would duplicate links on the page and prefer them where they are. Is there a way to get the bar to display without any links?

Why not just edit the tpl_header.php file? you could add a blank bar there.
zen-cart/includes/templates/template_default (or your template folder)/common/ tpl_header.php
