Ummm. It looks like it's installed now. I didn't install it, I was planning to run the update on the database and scripts.
I changed the path in the configure.php files from the old store. Would that cause the site to look like it has been installed?
I'll rename the configure.php files and add some blank ones in there.
Man, I'm really working to screw this up aren't I.
Any updates on this?

I'm also running into this issue as I am currently re-installing 1.3.8. When I first installed about a week ago, everything was fine. Can anyone in Zen Cart confirm that this is not a problem with their server? Thanks!
I don't think it's server issue. I renamed the folder with lowercase letters and the problem remained.
I created blank configure.php files and the problem remained.
However with the configure.php file from my working store, and the current store path the installer can connect to curl.
I tried ignoring the curl errors and going ahead with the install using my configure.php files from my store in public_html.
I changed the path to the folder I'm using. Chose to upgrade the db and scripts.
It worked to a point. However it isn't seeing my template which makes sense because I haven't copied over yet, and won't allow me to login to admin, even after using the password resend. This also makes sense since Curl has something to do with security.
Therefore the connection to Curl isn't there when 1.3.8. is installed into a separate folder.
Now I'm going to copy the working site into a folder, the copy the new site into the public_html folder and see if it works that way.
My only problem is that I've been making some good sales today. Hope I don't screw the pooch.
Well that didn't work.
I copied the installed new version to the public_html folder but instead of seeing the site all I saw was the installation index file.
I confirmed that all files moved.
I'm having the same problem!!!! I first tried to upgrade from 1.3.7, and didn't work, same "CURL requires SSL support" error. But it's inspection report shows SSL is installed. I tried ignoring the error msg and did database upgrade which caused hang.
So I wiped all the tables and directories, and tried to reinstall from scratch. Same problem "CURL requires SSL support error". But I ignored it again, and continued on and seems to install ok. Checked the database and all tables are there, the cart and admin area seems to work ok. Don't know what the consequence will be down the line, I guess I'll find out eventually.
For your info, my server runs: FreeBSD 6.2, Apache 2.2.3, PHP 5.1.6, MySQL 5.0.27, OpenSSL 0.9.8d, Curl 7.15.5.
