Default Copyright with a domain name

I recently opened an online store and used the domain easy-gardener.com Very soon after I started trading I had a solicitors letter delivered saying that I was in breach of copyright as another company traded under the name of easy gardener. I removed all ref to the words easy gardener and the products that I sell are garden products but not the same as this other company. Now they want me to move my site from easy-gardener.com to another domain. I have looked online and it appears that they may have a point.

ANY COMMENTS would be very much appreciated as I now have 26% off my turnover attributed to free listings.

Default Re: Copyright with a domain name

You need to seek professional legal advice. However, in my non-professional, non-expert opinion it doesn't fall under copyright law. It would probably come trademark law so you need to determine if they have any trademarks that you are infringing. Even if there is no trademark infringement it could well come under "passing off"...

You must take proper legal advice.

    Christian.
