It appears that when the free shipping is set to $100, any order less than $100 whose sales tax pushes it over gets free shipping.
how can you set it so that the order subtotal (PRE-TAX) must be >=$100 for free shipping?

can you give an example of an order where this happens.
I've just tested with 138 and it did not give me Free Shipping on an Item worth $95.00, even though the tax on that took it over $100.00

I just tested again with Display Price With Tax set to true, and there does seem to be a problem.
I assume you have Display Price With Tax set to true.
no, its actually set to off.
the problem only happens when the client is from the home state, and where sales tax is charged.
so if the client is from out of state, there is no issue with free shipping over $100
if the client is from out of state and the order is less than $100, shipping is charged.
if the client is in state, and order totals $100 or more pre-tax, it doesn't matter
but if the order is near $93, and is instate, that pushes it artificially over the $100, giving free shipping, which is incorrect.
is there a way for the free shipping to be set to look at the subtotal (or pre-tax total) for free shipping, rather than the total?

As I said, I cannot reproduce your problem with the settings you describe, I could only reproduce it with Display Price With Tax = True.
can you post details of the order totals at checkout , including the tax percentage you use.
A screenshot of checkout would be even better :)
sales tax is 7%
this is an order to the same state as the business.
