PayPal and forced Split Login

I have PayPal Express enabled and every time I have items in my cart the log in link will take me to "split log in" version of the log in page i.e. without the registration information. But if the cart is empty the same link will take me to the same page except the registration information for new customers will be displayed. I don't have split log in enabled and I don't want to have it. Has anyone else encountered this problem and does anyone have any fixes.

In the paypal module assuming you are using 1.3.9h has an option now to disable the express button prior to login.
