I'd suspect that your template designer (hello, Template Monster) has edited a file that was changed between version 1.3.9g (where this problem existed) and 1.3.9h (where it was fixed) so when you installed the template, you essentially reverted to 1.3.9g.

I would compare the files in the template package with the files that were changed in 1.3.9h to see which one(s) were edited, then replace the guilty file(s) with the one(s) from the 1.3.9h upgrade.
