DOB required

I have a store in which the DOB is required on account formation.

configuration>>minimum values>>DOB = 10
configuration>>customers details>> DOB = true

Mostly customer DOB are stored in the database. Occasionally they are not. I am not sure how this second option is possible. Any thoughts?

When I try and create an account and omit the DOB it creates a warning ( even with javascript disabled) Not sure how customers are managing to do it.

Any thoughts gratefully accepted.

Are those customers without a DOB paying with PayPal?

Oh, of course, it is a paypal express thing. Is there any clever solution to this for a store that actively wants to have DOB stored.
