Probably so, but it couldn't hurt to bug them... at the least, they deserve the aggravation:) And I don't know who else is going to look at their code to sort it out, unless the OP hires someone...

On an actually helpful note, your best bet might be to replace the template's menu with a mod that is proven to work correctly. There are several in Free Addons; if you want to use ez-pages, I know that the Ezpages Improved Menus mod has current-page highlighting.
