Your obsolete version of Zen Cart is not compatible with contemporary versions of PHP.
PHP 5.3, which came out 4 years after Zen Cart v1.3.8 was released, introduced changes to PHP syntax that are not compatible with that very old version of Zen Cart.
You need to use a contemporary version of Zen Cart that's compatible with PHP 5.3. Using v1.3.9h or v1.5.0 with is the newest as of today, would be your best solution.
MODERATOR NOTE: Closing this discussion because it is not a Zen Cart bug. It is the misuse of an older version that's not designed for the server you're trying to run it on.
