Can I prevent discount codes from being used on Special items that are on sale?

Running Zen Cart 1.3.8a at www.4130clothing.com

We offer our team members a 50% discount on clothing but we don't want them to be able to get 50% off a product that has already been discounted on our website.

Is there anyway to setup some sort of rule that makes it so the discount code only applies to products that are being sold at full price and excludes any item that are on sale or put in the specials section?

Also, while you are working on this, you need to be actively upgrading from 1.3.8a to (at least) 1.3.9h.

1.3.8a is old, hacker vulnerable, and not compliant with current PHP.
