Terms Agreed javascript check on Checkout process

When you have entered your credit card details and then submit the page at Step 2 of 3 (checkout_payment) without checking the "Terms Agreed" checkbox the system throws an error but then you have to re-enter your credit card details - which is a ball ache and I can see why people may just give up.

Therefore it would seem logical to prevent users from leaving this page unless they agree the terms and condition by doing a javascript check.

Now I may be being dum here but I can't find that option in the admin of the site so I wondered if anyone had come across this problem and had fixed it.
