How do I relocate the privacy statement?

I am using the split login or register a new accounts style in new installation of a cart that will replace our existing one. On the create_account page it has the privacy statement acceptance box positioned at the very top of the page. I have had several customers totally miss the box, fill in there information and not even see the error message about checking the acceptance box. I would like to position the privacy statement acceptance box at the bottom of the create_account page below the newsletters and email box and right above the submit button. After 2 hours and several text searches I can't find where to modify this layout.

Can someone tell me where this is at?
