Add Acceptance of Terms to Checkout Page

Is it possible to add a field to the checkout page where a customer must Accept the Terms of Use? This information does not need to be stored in the database but acceptance is required to continue with checkout with an error message if they do not check the field.

admin > config > regulations > Confirm Terms and Conditions During Checkout Procedure > set to true

Make sure you have the defines page for defines_conditions.php edited with your statements
