Running into this error sometimes Email Error: Could not instantiate mail function.

I get this error sometimes Email Error: Could not instantiate mail function. and i can't seem to figure it out. I can send a list of 100 emails and it works fine then another list will not work and give me this error. I think the problem is if the email doesn't exisist it errors out and doesn't send any of them. Has anyone had this problem and if so how did you get around it? I get the error in my inbox that says this

I think this is causing zencart to die. I have 1.3.7 installed and i don't have the newsletter addon installed.

Well I will guess i will just use phplist, since i tried for hours and couldn't figure it out and i don't see any solutions posted.
