Check to see if you can replicate the problem in a fresh clean uncustomied 1.3.8 setup.
If you can, then it should be filed as a bug report.
If you can't, then one or more of your addons/modifications has broken something.

Thanks for the input. It is likely a bug I have introduced.
However I think I may have isolated it further. I was comparing addresses in the DB and the one that doesn;t work has the value of 0 for entry_zone_id where as the other 2 address that work have 189.
If I 'edit' and 'save' the address within My Account the value gets updated to the same value of 189. It will then allow me to proceed with that address selected.
Sooo, The code/page that created the address in the database is not entering a valid entry_zone_id causing the address to be invalid.
I am pretty impressed with myself for troubleshooting this far but I know I have no chance of fixing the problem. Is anyone able to assist in troubleshooting this issue. I can upload any individual files if necessary.
