Default Free Delivery Coupon still adding VAT/TAX for delivery

This worked fine before our latest upgrade a few weeks back but we cant see any difference in the files etc and no amount of changing settings seems to change this.

Basically, If a customer orders £26.39 this would work out £22.95 for the items and £3.44 for vat (uk sales tax currently at 15%). Therefore if I have a free delivery voucher (normally £3) for orders over £25 it should work on this order total of £26.39 but it is basing the coupon redemption value on the pre-vat amount of £22.95 and saying the coupon cannot be used. We have one website showing vat inclusive prices and one website showing vat exclusive prices and it does this on both.

We therefore decided to set up the coupon for the pre-vat amount saying redeemable for orders over £25 (£21.73 excl vat) in the description with £21.73 being the qualifying amount for the coupon to work. This does allow the coupon to be redeemed on the above pre vat order of £22.95 however it still calculates vat on the delivery amount despite this being zero due to the coupon offering free delivery.
    BEFORE COUPON ADDED:
    Sub-Total £22.95
    Postage £2.61
    VAT £3.83
    TOTAL £29.39

    AFTER COUPON ADDED:
    Sub-Total £22.95
    Coupon (Free Delivery) -£2.61
    Postage £0.00
    VAT - £3.83 (should be £3.44)
    TOTAL - £26.78 (should be £26.39)

We tried changing the sort order which made no difference and this problem happens with both websites we have one showing vat inclusive and one vat exclusive.

Current Sort Order on VAT INCLUSIVE WEBSITE:
    COD Fee ot_cod_fee
    Discount Coupon ot_coupon 280
    Group Discount ot_group_pricing 290
    Gift Certificates ot_gv 840
    Low Order Fee ot_loworderfee 400
    Shipping ot_shipping 500
    Sub-Total ot_subtotal 100
    Tax ot_tax 600
    Total ot_total 999
We cant show the current sort order on the VAT EXCLUSIVE website as trying to change it to vat inclusive caused all sorts of problems - see here: http://www.zen-cart.com/forum/showth...367#post792367

Any help appreciated as we just sent out over 3000 newsletters with a discount code that wont work properly - we did not check beforehand as its worked perfectly for past couple of years and the upgrade showed no major difference with these coupons.
