New Products still showing Sold Out and Disabled Items

When an Item sells out or is disabled the I tem is still showing in the New products for the month listing. New products is still showing products that are not new say this month may. How can I fix this?

The Item in question is the O Gauge NH (Eastwind) EP-3 Electric Engine PS 2.0

I'm using 1.3.9h, but I still have this problem with disabled products showing up in the New Products center box.

I had a look at the Bug fixes that are referred to, but I'm not using 1.3.8.
The new_products.php has the same code as the bug fix told people to use when replacing the code in 1.3.8.

Any idea how to fix this?

There is a difference between Sold Out, products_quantity <= 0, and Out of Stock, products_status = 0 ...

If you want to never see Sold Out Products on your site, you need to change the settings in Configuration ... Stock Settings ... so that out of stock products have the Product Status, (products_status) set to 0 on an Order ...

If you want to show Sold Out Products but not show them in the New Products ... then you need to customize the code for the Centerbox, Sidebox and New Product listing to not include Products with a products_quantity <= 0 ...

NOTE: The bug in v1.3.8, was where the Products with products_status = 0 were still showing ...

NOTE: to set products_status = 0, when Products are Sold Out on an Order, you would need to update the existing Products as this is only controlling new Orders on the check out ...

Thanks for the quick reply.
I'm a bit embarrased now....I forgot to check the module template override file
I bought a template supposedly for 1.3.9g.
However, the 1.3.8 bug fix was not implemented in the new_products.php file.
Made the change in the code, and now it works beautifully.
Will have to have a word with the company I bought the template from, to see if any other files are not 1.3.9.

Thanks for the update that you were able to fix this and for posting the cause was an out of date template and override file ...
