    Nothing is 'illegal' - the customer isnt being force to buy if they don't want to...though it could be illegal at a restaurant when its added to the bill after you have already eaten...but they get round that by calling it a 'service tip' lol...

    What is wrong is its a bit underhand...Its a credit card fee, but you can only pay by credit card....so why not just put all your prices up by 3%.........? We know why...

    @GoldenMonkey- at this time, in the United States, it is a violation of the TOS of all 3 major credit cards.
    This is why you don't see it EVERYWHERE because if it was allowed, it would be done.

    Even if it was allowed, you should think twice about doing it, because checkout-time fees are a big reason for cart abandonment.

    It is against TOS to charge customer "3% Credit Card Fee", but is it not against TOS to charge "3% Order Processing Service Fee". At least this is the case in Canada.

    We are making 2-3% on our product, let them abandon the card, we are not going to sell for loss.

    I believe any fee that was applied across the board would be acceptable to the cc companies - just don't call it a cc fee, and don't apply it only to cc users if you have any other forms of payment.

    Our TOS agreement says we cannot charge a %. We use the low order module and call it an on-line convenience fee to our members and it is a flat fee no matter what they order. Our DMV does it to for renewing on-line. Of course, if customers choose to order by mail/fax and pay by credit card, there is no charge. It is more than covered by our on-line fees. And, of course, if they pay on-line using a paypal account, they still pay the fee.
