After adding TOC links, I also added a separate ezpage not connected to the first links but it shows the dang navigation anyway. I checked with another previous installation and see no difference in the way the pages are set up. In another installation with no TOC pages, it does not happen.

well geez, added chapter numbers in and voila a fix. Maybe it's been a while....
