You're using PHP 5.3, which is not compatible with Zen Cart v1.3.8a and older.
Until the next version of Zen Cart is released, you'll need to use a PHP version lower than 5.3.0

There are several other incompatibilities beyond just that one message. Merely commenting out the one line is not sufficient.
