dist-configure.php files missing from v1.3.8?

Missing files: The following two files are missing

includes/dist-configure.php and admin/includes/dist-configure.php

how come and where can I download them?

If your ZC is already installed, then it's likely the dist_configure.php files were CHANGED to just configure.php

The dist_configure.php files are not needed in a completed install, and should be removed.

Please read the INSTALLATION INSTRUCTIONS that accompany the core files (see the DOCS folder for these instructions).
