it's legal to SELL zen cart as a cms made by others?

I have found this webpage..that sells ecomerce pages, at the bottom are some examples, and I can swear that the second one (the first page doesn't open) is a zen cart shop..

if this isn't zen cart, i'm sorry to have posted this here...but if it is, and i'm very surely after using it a year. isn't this ilegal?

The consuelamadrid site is running osCommerce, not Zen Cart.

Maybe I'm wrong but this:
sstore.pl
seems to be the case.
I've seen source code of previous sstore version and it looked to ma as a modified zencart with removed any info about zencart. The new version is encoded. On this page is cue:
