Automatic subscribe to newsletter?

When new clients log in for the first time I want them to subscribe to newsletters with an option to unsubscribe on the actual email when they receive it.

In Admin/Configuration/Customer Details/Show Newsletter Checkbox there a 3 choices for Show Newsletter Checkbox:
0= off, 1= Display Unchecked, 2= Display Checked

and there is a note also "Defaulting this to accepted may be in violation of certain regulations for your state or country"

Sales on this site will be to USA only. Does any state have this regulation because I would like to use #2.

Ys, to stay clear of being suspected of SPAMMING, you really need a "Double opt in system".

There are no such laws in the US I'm aware of, but I'd agree with kobra - some other thoughts here:

I looked at the link and have an idea.
I thought perhaps to make an unsubscribe option in the Thank You page and also remind to white list.

The subject line for the newsletter would be 'websiteName Newsletter thisMonth' and not use content title for the Subject. This way I thought to get round the spam issue and be honest with people.
