any ideas why thisa is happening

after applying the PHP 5.3 patch to V1.3.8

Have you changed the standard subscribe/unsubcribe method for Zen Cart?
You should be considering upgrading to at least 1.3.9h as your version is a hacker's thrift store.

We intend to upgrade to V1.5 but woudl like to get this working before hand!

Sounds like maybe you uploaded non-admin files to the admin area, and/or vice-versa
