Downloads set to Free Shipping won't skip Checkout Step 1 of 3

Hey gang,

I have a weird one for ya.

I sell physical CDs or downloads in the same SKU.
Each physical CD has additional attributes that can be added to the item or default to (none). This causes the checkout to list all the attribute during checkout - either selected or (none).

i.e.

• SONG ON CD shipped | 99144000 - E - 5:40
  Key Changing - (none)
  Digital Editing - (none)

I also offer these additional attributes on the downloads, although the customer receives the extra files via an ftp download after it's completed in our recording studio.

i.e.

• MP3 DOWNLOAD | 99144000 - E - 5:40
  Key Changing - (none)
  Digital Editing - (none)

Now, because the download selection includes these 2 extra attributes that are not tied to a zip file in the products_attributes_download database, anyone ordering a downloadable product will always reach Step 1 of 3 Checkout even though there obviously isn't any shipping.

Over the past years with 1.3.8, I modified the tpl_checkout_shipping_default.php file to have 2 different piece of text within that Step 1 of 3 to reflect a download or physical overall purchase and further describe that the additional files will be sent when completed.

In the past couple of months, I've decided to create a new 1.5.1 website from scratch to clean out all the old plugin code I don't use anymore. I cannot get this same modification to appear in the updated website by comparing the old and new versions of the tpl_checkout_shipping_default.php file.

Does anyone fix this or have another way to do this modification that will look clean and allow for easy upgrading in the future?

I got it. I based the changes between downloads only and physical CD page 1 of checkout on the Weight for the code. I was able to locate what I needed in the Shopping Cart module page.
