Must confirm agree to terms - Missing

I go thru the regulations and set agree to terms and true, and it doesnt show up on order screen, I can set the privacy and it shows. I did a tools search and cant even find the text for agreeing to the terms. Please tell me what I am doing wrong.

You see the check box on this page

The terms are a define page

admin > tools > define page editor > select conditions
