Down for Maintenance not working

I have my shop as down for maintenance but it is still allows customers to log in and make purchases. It was working fine on the test site but it was running v1.3.9h with a database v1.5.1 and it looks like this:

Now I am finally running v.1.51 w/a database v. 1.5.1 and it looks like this and everything is fully functional. Customers can view products and place orders although I am still working out the kinks:

What am I missing?!

Was there a solution for this??? I upgraded & had a few problems so I put the site Down for Maintenance. Now that all is fine I thought I turned it off but it is still active. So I checked it, turned it back on then back off but it does not respond. Even with Down for Maintenance is set to false in Admin, it shows true on store side???

Check the files:
/includes/configure.php
/your_secret_admin/includes/configure.php

are they both using the same database settings?
