GPL Violation?

Greets, i'm new here, bit longer diggin' through the code to understand how it works, but i'm a big follower of opensource/GPL/CC products, commuities and all this and it anger me when i see things like http://www.kiosk.iki.pl/index.php?main_page=product_info&cPath=68&products_id=181 or http://www.kiosk.iki.pl/index.php?main_page=product_info&cPath=68&products_id=182 and third version on the same site... http://www.kiosk.iki.pl/index.php?main_page=product_info&cPath=68&products_id=482 !!! and they call the 3rd one PRO !!!!!! i'm taking you do not understand polish so i'll tell you the more spicy things...

from the first link, paragraph before server spec requirements:

Application is based on the earlier prepared engine Zen Cart which was based on osCommerce. Few things differ it from the original, translated interface, environment suited for poland (taxes/areas etc.). This application is <b>Somewhat a clone of Zen Cart but it isn't a copy</b>no word about it beeing freely distributed open source software, no links to the orginal files, all they've changed is translated language packs and added few variables for polish environment... Few lines earlier it says that it is allowed thanks to GPL to freely edit the source code but blast! it doesn't mean translate the variables and sell !!

the 2nd one is base /cough on the first one, and updated to higher version of Zen Cart (1.2.41) and guess what it says...

this application is somewhat a clone of Zen Cart and Ram Zen Cart (the previous link) but it isn't a copy!...
the best for the end... this one almost made me cry...
Zen Cart updated to 1.3.0.1... and then to 1.3.0.2 and they are boasting that they have made to increase the performance by up to 15% WOW! THEY MADE !! isn't that nice of them? what further on? what you can see? they are selling the PRO not only with their translation but they also add extra languages (for extra money) and i BET (yeah...) that they are the authors of these translations, wondering why their translations are only for the languages that were earlier released on zencart and so on...

if they were taking money for extra support in polish... ok
if they were taking money for design... ok
if they were taking money for hosting... ok
but they take money for translating variables and selling code that isn't their, they sell the usability of it!
and from what i've read on their forums people were saying that some of the things after installation weren't fully translated to polish hahaha...

there is one thing i hate more then people who let other fool them...
FOOLS WHO MAKE OTHERS BEEING FOOLS!!!!!!

please tell me if what they do is violating the GPL rules cause my view on it was a bit different...

Sorry, but as far as I can tell they are not violating the GPL as long as they have not removed our copyrights. I do not speak or read Polish but they seem to acknowledging Zen Cart everywhere.

Oh well, it seems the GPL is less strict then i tought, can't tell if they have removed the information from the code cause i'm not realy fancy to pay for things that are shared by its creators for free /sigh, the only one who deserves money for the hard work is you imo, cheers

and btw, their acknowledment to Zen Cart all around the page is pointing at Zen Cart PL, product they take for theirs, and somebody who doesn't know what Zen Cart is will not know that it is originaly provided for free, that's not fair imo and it makes use of people's unawareness

Wow, that's some really out-of-date information. Makes me wonder whether the Zen Cart Certified Hosting claim is (still) valid.

I also see that you are advertising a zen cart certified how,
I have never seen that host in the list,

If you read carefully, it does say "Zen Cart PL Certified Hosting", I presume meaning that "Zen Cart PL" is doing the certifying. So not technically wrong...

The Certified Hosting graphic is copyrighted and using it without our permission is copyright infringement. As is using any other graphics or copy or text from this web site. The code is GPL but removing our copyright headers or selling the code violates the license.

Sorta what I thought. I didn't get around to checking to see if the whole certified logo looked like yours, but they had obviously lifted the "zencart".

Derek,

just because you added a red PL to it doesnt make it a new image,
it is still a copyrighted image, and you are in violation.
