Hello,

Just wondering if this is legal?

Someone selling re-named ZenCart on TradeMe (New Zealand Largest Auction Site) for NZ$599 per license. :blink:

I thought it's illegal to sell open-source software? I warned him but he decided to continue.

Samples found on his website :.eazyshop.co.nz

You can see from samples they all use ZenCart (zenID etc in source code, and admin login page is same as ZenCart standard admin login).

First let me say I don't condone selling it but....

It depends on how he words it to the customer when they purchase it, can't tell from the description. I've sold many open source software to clients.. let me finish first before getting the noose around my neck! I tell the client the software itself is free and open source however it'll be $xxx for me to setup and customize it for them. So to the client they are paying $xxx for the entire thing and to an outside observer this would look to be wrong doing, when in fact it's not.

So he could be doing the same thing. What looks like charging for the entire thing is really and full setup with maybe a template he created for example.

Now, with the price he's charging it's a little out there but just wanted to play devils advocate.

Cyberkill, I agree with you about selling services including setup etc; however, this one has definitely gone over the line:

I agree, there is nothing wrong for charging someone for the distribution, installation or support for GPL'd software, in fact businesses such as RedHat make a very good income from it.

As for this person from NZ though. He doesn't appear to be charging for the software as such, only the "Licence" to use it, which I'm guessing is a support licence rather than a product licence.

However, he does appear to be misrepresenting the software itself. He has removed almost all references to zen-cart and seems to be promoting it as his own software. He is probably also contravening sections 1 and 2 of the GPL

He is actually selling a product license, at least from the description:

So what do I get for $899?
One license for a customized online shopping cart valued at over $3,000 to operate one online shop.

Yes, definitely zencart. Anyone familiar with the zencart php code only has to look at the source code of "eazyshop" and it is instantly recognisable.

I expect the devs have seen this and, from my experience, are working on it and would prefer that it not be further publicized.

Its evident that it is ZenCart, busted with "zenid" in the URLs of all the demo sites.

not only have they removed the ZC copyrights,
they are selling this with TM templates,

Cool, are they selling pirated TM templates? Or reselling legit ones?
If they were pirated, that would be someone else with teeth to go after them.
