Display, but not require, Terms and Conditions - Possible?

I'd like to display the terms and conditions language during checkout but not require that a checkbox be checked.

Is this possible?

Directly in the shopping cart is this and you can edit this to include your statements and maybe then move it to below the items in the cart

Your Shopping Cart Contents
You may want to add some instructions for using the shopping cart here. (defined in includes/languages/english/shopping_cart.php)
