Free shipping on orders over $X problem

I seem to be having a whole bunch of problems with my order total module. First off I would like to fix the problem with my free shipping on orders of $100 or more. I want it to allow the free shipping on orders $100 before tax. Right now if someone orders something that is $90 it still gives them free shipping because the taxes make it over $100. I don't want that.

I just looked at all the shipping/tax settings I could find and there didn't seem to be a way to set this the way you want. You could make the free shipping over $110 but that would penalize your out-of-state customers.
