newsletter subscription trouble

when some customers try to login and update their newsletter subscription, they are getting this error.

1062 Duplicate entry '[email protected]' for key 2
in:
[INSERT INTO subscribers (customers_id, email_address, email_format) VALUES ('788', '[email protected]', 'HTML')]

please help.

Another problem seems to be when a customer receives the newsletter confirmation email and it instructs them to click the link to confirm their email address, it takes them to a page with this error at the top:

This email address has already placed a Newsletter-Only subscription.
